Welcome to ZIVASKA. By accessing or using our website and placing orders, you agree to be bound by these Terms and Conditions. Please read them carefully before making a purchase. If you do not agree with any part of these terms, you must not use our services.
These Terms & Conditions govern your use of the ZIVASKA online store, including browsing, account registration, purchasing products, and all related interactions with our platform.

3. Products & Orders
3.1 Product Descriptions
ZIVASKA makes every effort to display products accurately, including images, descriptions, and pricing. However, we do not warrant that product descriptions or other content on the site are complete, reliable, current, or error-free. Colors and appearances may vary depending on your device display settings.
3.2 Order Placement
Placing an order on ZIVASKA constitutes an offer to purchase. An order is only confirmed once you receive an order confirmation email from us. ZIVASKA reserves the right to refuse or cancel any order at its discretion, including in cases of pricing errors, product unavailability, or suspected fraud.
3.3 Pricing & Taxes
All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change without notice. Applicable taxes — including GST, HST, or PST depending on your province of residence — will be calculated and clearly displayed at checkout before your order is confirmed. ZIVASKA complies with Canadian federal and provincial tax regulations.
4. Payments & Refunds
4.1 Payment Methods
ZIVASKA accepts the following payment methods:

- Digital Wallets (Apple Pay, Google Pay, PayPal)
- Buy Now, Pay Later options (where available)
All online transactions are processed through secure, encrypted payment gateways. ZIVASKA does not store your card or banking details on its servers.
4.2 Payment Security
We use industry-standard SSL encryption and comply with applicable payment security standards (PCI-DSS) to protect your financial information. However, you acknowledge that internet transactions can never be guaranteed to be 100% secure, and ZIVASKA cannot be held liable for any breach that is beyond our reasonable control.
4.3 Refund Policy
ZIVASKA is committed to customer satisfaction. In accordance with applicable Canadian consumer protection laws, refunds are available under the following conditions:
- The item received is damaged, defective, or significantly different from the product description.
- The order was cancelled before dispatch.
- Delivery could not be completed within the estimated delivery window.
To initiate a refund, customers must contact ZIVASKA support within 14 days of receiving the order, providing proof of purchase and photographic evidence where applicable. Refunds will be processed within 5–10 business days to the original payment method in Canadian Dollars (CAD).
4.4 Non-Refundable Items
Certain product categories may be non-refundable or non-exchangeable, including perishable goods, personalized or custom-made products, digital downloads, and items explicitly marked as final sale at the time of purchase.
4.5 Cancellations
Orders may be cancelled within 24 hours of placement, provided they have not yet been dispatched. Once an order is shipped, cancellation requests will be treated as return requests in accordance with our return policy.
4.6 Chargebacks
If you believe a transaction is unauthorized, please contact us at support@zivaska.com before initiating a chargeback with your bank. ZIVASKA reserves the right to suspend accounts where fraudulent chargeback activity is suspected.
5. Shipping & Delivery
ZIVASKA aims to dispatch all orders within 1–3 business days. Estimated delivery timelines vary by province and shipping partner. Standard delivery across Canada typically takes 5–10 business days. Expedited options may be available at checkout.
While we make every effort to meet stated delivery windows, ZIVASKA shall not be held responsible for delays caused by courier partners, weather conditions, Canada Post disruptions, customs processing, or other circumstances beyond our control.
Risk of loss and title for purchased items pass to you upon delivery of the items to the shipping carrier. You are responsible for ensuring accurate delivery information is provided at checkout. ZIVASKA is not responsible for packages lost due to incorrect addresses provided by the customer.

ZIVASKA is committed to protecting your privacy in compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

8. Prohibited Conduct
When using ZIVASKA, you agree not to:

ZIVASKA’s total liability for any claim arising from or related to these Terms shall not exceed the amount paid by you in Canadian Dollars (CAD) for the specific order giving rise to the claim.
